1. About this policy

This document, (the “Privacy Policy”), describes the collection, storage and use of the data that you give to us (“Movestack”) and which we collect, only via our products and services, which include our website (the “Site”), our mobile application (the “App”) and any interaction we have with you over official communication channels. It also describes where and to whom your information is visible and what control you have over it.

Movestack is committed to collecting and using your personal data with the understanding that it always belongs to you. We implement the collection, storage and use of your personal data in a way which respects that fact. Personal data we choose to collect is done so with the intention of enabling the best experience for you.

Where we refer to the “System”, we refer to technical and/or digital components that enable and facilitate the operation of the “Service”, where the “Service” is collectively the Site, App, System and aforementioned communication channels.

2. The information that we collect

2.1 Information you give to us

When registering for the Service, or registering interest in the Service, you give us information which makes up your identity within the Service. This information may include your:

  • Contact email address
  • Profile Name
  • Profile Image

Some of the above information may be gathered via or from a 3rd party if you decided to use the 3rd party to authenticate with the Service, such as by clicking “Continue with Google” or “Continue with Apple”.

Other information not necessarily categorised as personal information, that you give to us, includes:

  • Content that you upload to the Service

2.2 Information we collect

Through the use of the Service, we collect information so that we can enrich your identity and presence within the Service, enrich the experience we present directly to you and help us to understand how to make the Service operate and perform better technically.

The information we collect to enrich your presence and experience includes:

  • Your actions and usage within the Service and when (date and time) those actions were performed, including but not limited to:
    • Doing workouts
    • Following and interacting with identities and content within the Service
  • Our understanding of your interests related to content and identities within the Service

The technical information we collect includes:

  • Information relating to the device that you use to access the Service such as:
    • IP address
    • Type
    • Operating system
  • Information which represents identification of your usage sessions
  • Information about how you interact with each component of the Service such as:
    • When and for how long you spend on each screen or page
    • How you interact with items within each screen or page

3. How we use the information

3.1 Information you give to us

We use the information you give us to address you, send you communications related to the Service and construct and present your identity to other identities within the Service.

We use content that you upload as the core of the product provided by the Service.

3.2 Information we collect

We use the technical information we collect as part of engineering processes to monitor the operation of the Service and identify issues with the operation of the Service. This may be a part of responding to signals that we receive directly from the System, or in response to you raising issues with us.

We use information relating to your usage of the Service to better understand the Service as a product and during internal exercises on finding ways to improve the Service for you and for other users of the Service.

We use technical information relating to your interaction with content within the Service in combination with our understanding of your interests to provide you with more content with the intention of curating the best experience for you.

We use your usage information to present to you and others within the Service insightful views on how you use content within the Service.

  • Contract: We use information to perform the obligations we have as Movestack in order to provide the Service to you
  • Legitimate interest: We use the information to create the best experience for you, where these interests do not conflict with your interests and/or fundamental rights as described in this Privacy Policy
  • Consent: We use information under which you have provided consent in order to provide the Service to you, until a point where you withdraw your consent.
  • Legal compliance: We use your information if required in order to remain lawful.

4. When and where we disclose the information

Unless you choose to do otherwise, your information as visible and in interpretable forms is kept entirely within the Service and internally within Movestack.

Within the Service, your personal information publicly available includes:

  • Your profile name
  • Your profile image
  • Identities within the Service that you follow
  • Identities within the Service that follow you
  • Workouts that you have done, and associated data collected as a result of you doing a workout (such as duration)
  • Content that you have uploaded
  • Interactions that you have made with content as publicly available (which means that if the content you interacted with is publicly available, your interactions with that content are also publicly available)

Within Movestack, your personal information may be disclosed to members of Movestack in order to carry out the Service with respect to:

  • Customer service
  • Legal compliance
    • This includes processing your uploaded content.

Within Movestack, your personal information after being anonymised is disclosed to facilitate all other uses of the information as described in 3.

5. Data storage and retention

All data within the System is stored within the United Kingdom, either on servers that we configure to be secure, or on platforms provided by trusted 3rd parties. Where we employ 3rd parties to host your data, we ensure that they do so within contract and securely. The situations where we employ these 3rd parties to do so are, for example, where we replicate data for System resilience and stability.

Unless we indicate otherwise, it is safe to assume that we never delete your data so long as you have an identity within the Service, and so long as it is necessary whilst and/or to be lawful.

Any data we store belonging to you can be deleted if you instruct us to do so. The process is as follows:

  1. You instruct Movestack to delete your data via methods provided to you throughout the Service, or by contacting Movestack
  2. Your identity within the service is disabled within a reasonable and practical short-term period. The implications of this action include:
    1. Your identity is no longer followed or followable
    2. Your identity is no longer searchable
    3. Your identity is no longer viewable, including by you
    4. Any content you uploaded to the Service becomes inaccessible, with the exception of:
      1. A minimal set of detail, which cannot be used to reinstate the content nor identify you, of the content used to perform a workout by another identity within the Service.
  3. Your data is then deleted irreversibly from the System at 30 days after your instruction, unless you reverse your instruction before that time.

6. Cookies

Cookies store small pieces of information in your browser. They can be stored when visiting a website, and retrieved if visiting the same or related websites afterwards. The length of time cookies are stored and retrievable depends on the type of cookie. Session cookies are available to retrieve until you close the browser for that website. Otherwise, cookies are persistent either forever (until you clear them), or until an expiry configured by the origin of the cookie.

The origin of the cookie can be System servers (“1st party”), or 3rd party services. Where we introduce the use of 3rd party cookies, we ensure that they align with our Privacy Policy.

We use cookies in ways which fall under two categories:

  • Strictly necessary: these cookies are required in order for the Service to function, for example, information and IDs to authenticate your access to our protected services within the System
  • Analytics: these cookies are used to enrich, and facilitate correlation of, usage information we collect to make it useful to us when analysing it. For example, if you visit the Site multiple times, we can interpret your visits as by one unique individual, instead of as multiple individuals (which would accurately represent the reality)

By design, you have full control over cookie usage without needing to contact anyone. Otherwise, we provide the ability to ask us to disable attempts to use cookies on components of the Service. You also have the ability to disable cookies for all sites in your browser.

However, be aware that if you do choose to disable cookies, parts of the Service may not work as intended or the Service may not work at all.

7. Your rights

We intend to uphold your rights as an owner of your data. Your rights include:

  • the right to access personal data held about you: This means that you can request a copy of your data that we store about you where possible. Where this is not possible is if it implicates the data of another identity within the Service
  • the right to be informed about how and why your data is used: This is the Privacy Policy you are reading. Otherwise, we’re happy to answer any question you may have over and above the content in the Privacy Policy.
  • the right to have your data rectified: If you have found that information about you is incorrect, you can contact Movestack in order to have it corrected. Often this can be done yourself.
  • the right to have your data erased: This is possible as per section 5 of this Privacy Policy.
  • the right to have your data restricted: In cases where your data is inaccurate, we have done something unlawfully, you have made an objection or the data is not required in order to facilitate the correct working of the Service, you have the right for that data to be restricted. You can contact Movestack in these cases.
  • the right to object: You can object to our use of your data we store in cases of legitimate interest.
  • the right to portability of your data: This applies to situations where you receive a copy of your data from us and require transferring it for use by another party.
  • the right not to be subject to a decision based solely on automated processing: We do not employ automated processing of your data with outcomes that may legally implicate you or have a similar level of effect.

8. Privacy Policy Updates

As Movestack and the Service continues to grow, we may be required to update the Privacy Policy in order to reflect the Service.

When we do so with material changes, we will always communicate these changes and provide easy access to the updated policy on or before these changes take effect.
